Panel: Creative Industries in the Digital Environment

My Commentrary: Nothing particularly interesting until Jared Jussim from Sony Pictures Entertainent spoke about film rights, copyright and economics. I’ve video – taped some of it – I think he has a good point in terms of costs. Listen to what he says about Lawrence Lessig and the Creative Commons.

A very good question to him was posed by Mrs. Irini Stamatoudi, the Director of the Hellenic Copyright Organization on what Sony has done to its model to actually adapt to the internet age. Mr. Jussim listed some different things that Sony does that especially to deal with problems in specific countries. Yet in actual answer to the question he did not present a different model for internet distrubution even though he promised that Sony is planning and researching constantly. Not very satisfactory in my opinion but well done to Mrs. Stamatoudi for a great question.

Topic1: International Legal Framework

Reate of evolution in IP system & copyright is increasingly rapid. Keeping with development in technology and ever changing business models.

The copyright system maintains an equilibrium constantly being adjusted at the national level to protect the artists rights and encourage innovation.

The reality is that consumers thus far have been adapting faster than creative companies that produce the products that they consume.

WIPO will continue to maintain balance with respect to right holders needs and users expectations. We want to make the IP system increasingly more relevant. To take this up we need to strengthen our tech capacity and stay neutral.

Counterfeiting and piracy are not victimless crimes. States think respect for IP worldwide is extremely important (as evidenced by legal proceedings against piracy).

WIPO is working with the OECD to measure the effects of counterfeiting and piracy.

Topic 2: Protecting Online Content

Mr. Jussim talks about films and copyright and in the process shares his not so soft comments on Creative Commons and Lawrence Lessig (go to min. 3.15 if you only want to hear about Lessig but the rest of his speech is pretty interesting too.

Topic 3: Collective Management in Support of Creators in the Digital Era

The creators’ voice should be heard by the European Commission

Rights holders and ISPs need to join forces. The most attractive forum of collaboration seems to be the blanket license – based on the broadcast model from the past.

Some amendments of copyright laws are necessary as well as an opt-out choice. An initiative in Iceland is due to start next year. Most are excited to try this out and see how it works.
